General conditions of sale
Here is the English translation:
GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale ("GTC") govern the purchase of products and services through the restylit.com website (the "Site") and regulate the contractual relationship between the user/customer ("Customer") and Restylit S.r.l. ("Restylit" or "Seller").
1. SELLER INFORMATION AND SCOPE OF APPLICATION
Products and services purchased on restylit.com are sold by:
Restylit S.r.l. – VAT No. 02505820221 Registered with the Companies Register of Trento on 14/05/2018 Registered office and operational headquarters: Via dei Palustei 16, Meano di Trento (TN), Italy
These GTC apply to all purchases made through the Site and, where applicable, also to orders placed via customer service, quotation, and order form.
Prices are indicated in Euros (or in another currency selected by the Customer) and, unless otherwise stated, include VAT for sales subject to taxation. Any additional costs (shipping, ancillary services, etc.) are indicated separately before order confirmation.
2. CONTRACT CONCLUSION AND PURCHASE PROCEDURE
2.1 Online Purchases
To conclude a purchase contract on the Site, the Customer must:
- select products/services and add them to the cart;
- complete the checkout process by entering the required details;
- confirm the order and complete payment.
Upon completion of payment and order confirmation, the contract is deemed concluded.
2.2 Orders via Order Form, Quotation, or Operator
The contract is also deemed concluded when Restylit receives:
- the Order Form duly completed and accepted by the Customer, and
- the related payment or deposit.
In the case of an order placed by phone by an operator on behalf of the Customer, the contract is deemed concluded upon receipt of payment. The Customer is required to carefully verify the details shown in the order confirmation.
2.3 Acceptance of Terms
By submitting the order and/or completing payment, the Customer declares to have fully read and accepted these GTC.
2.4 Applicable Law
The sales contract is concluded in Italy and is governed by Italian law.
Should the Customer disagree with any part of the GTC, they are invited not to proceed with the purchase and to contact Customer Service for clarification.
3. AVAILABILITY, ERRORS, AND ORDER CANCELLATION
Restylit endeavours to keep the catalogue up to date; however, a product may be unavailable or there may be material errors (e.g. incorrect price).
In the event of product unavailability after the order, Restylit will promptly inform the Customer, who may choose between:
- replacement with an alternative product / order modification; or
- refund of the amounts paid for the unavailable item.
For single-unit Outlet products, in the event of simultaneous orders, the order paid first takes precedence.
In the event of a manifestly incorrect price:
- if lower than the correct price, Restylit may contact the Customer to confirm the purchase at the correct price or proceed with a refund;
- if higher, Restylit will refund any difference.
4. CHANGES TO PENDING ORDERS
Order changes are guaranteed only until the items are put into production; production may begin immediately after payment or deposit.
Subsequent requests (products, finishes, shipping methods, addresses) are considered exceptions and may only be accommodated subject to verification of the progress status.
For made-to-order / custom production items, order cancellation is only possible within 24 hours of placement, unless otherwise stated in writing.
Billing details may only be amended prior to invoice issuance. Changes to the delivery address, where technically possible, must be requested by email to Customer Service.
Refunds are processed using the same payment method originally used. The amount refunded is that actually received by Restylit; for payments in currencies other than Euro, the refund is made in Euros net of any bank/conversion fees.
5. SHIPPING AND DELIVERY
Shipment is initiated only once the order is fully paid. Deliveries are carried out by furniture specialist couriers, generally with prior telephone notice.
5.1 Type of Delivery
Standard Shipping means delivery to the kerbside/ground floor (ground level at the nearest point to the entrance accessible by the vehicle). The Customer is required to assist with unloading from the tail lift when requested, including arranging additional personnel based on the weight and dimensions of the packages.
Any services such as delivery to upper floors, porterage, or assembly are only available if expressly purchased and/or quoted.
5.2 Mandatory Customer Communications
The Customer must notify Restylit in advance of any logistical issues (ZTL/restricted traffic zones, inaccessible roads, narrow stairways, split-level floors, no lift, complex entrances, etc.) and verify that spaces are compatible with the dimensions and weight of the packages.
Additional costs arising from failure to communicate such issues (e.g. aerial platform, second delivery attempt, access impossibility) are not attributable to Restylit.
5.3 Spot Checks
Restylit may open certain packages for spot checks and photographic documentation. Restylit is responsible for the goods until delivery as required by law.
5.4 Warehouse Collection
Collection from Restylit or partner warehouses is possible, subject to prior arrangement with Customer Service.
6. MANDATORY PROCEDURE FOR RECEIPT, INSPECTION AND CLAIM (PHOTOS/VIDEO – RESERVATION – TIMEFRAMES)
This procedure is essential to protect the Customer in the event of transport damage or anomalies.
6.1 At the Time of Delivery (Unopened Packages)
- Always take photos/videos of packages while still sealed, even if the packaging appears intact.
- Check the integrity of the packaging.
- Always accept the goods, even if packaging is damaged.
- If there are anomalies on the packages (punctured, dented, opened, wet, etc.), the Customer must sign "WITH RESERVATION FOR INSPECTION" specifying the reason in detail. Generic reservations are not accepted.
- Even with intact packaging, it is recommended to indicate "COLLECTED WITH RESERVATION FOR INSPECTION".
6.2 After Opening the Packaging
- Open carefully (box cutters/blades may damage products: such damage is not covered).
- Inspect products before assembly.
- Document any defects/anomalies with photographs.
- Defects not visible externally must be reported within 24 hours of delivery with photographic evidence.
6.3 Assembly
Once a product has been assembled, as a general rule, it is not possible to acknowledge or compensate for damage not reported and documented prior to assembly.
6.4 Original Packaging
For returns or collections, original packaging and pallet must be retained. Returns without original packaging and pallet (where applicable) will not be accepted.
7. SHIPPING COSTS
Shipping costs are calculated at checkout based on the delivery address and selected method. Any ancillary services (upper floor delivery, porterage, assembly) are indicated separately.
8. PRODUCTION AND DELIVERY TIMEFRAMES
Timeframes indicated on the Site are estimates based on previous orders and manufacturer information. For each order, Restylit may provide within 7 days a summary sheet with production timeframes.
Most products are made to order; in such cases, minor delays fall within the "additional period appropriate to the circumstances" as provided by applicable regulations.
Restylit keeps the Customer informed of order status. During particular periods (Christmas holidays, summer closures, etc.) delays may occur.
An extension of up to 90 days beyond the originally expected date is possible. After this period without delivery, the Customer may request termination and a refund of the amount paid, subject to any different protections applicable in cases of personalised/made-to-order goods within the limits of law and progress status.
If delivery timeframes are critical to the purchase decision, the Customer is invited to contact Customer Service in advance.
9. LIMITATIONS OF SITE USE AND ACCURACY OF INFORMATION
Restylit works to ensure maximum accuracy, but inaccuracies may exist. The Customer is required to verify, prior to purchase, the characteristics they consider essential (dimensions, combinations, finishes, colour compatibility).
Colours and textures of natural materials (wood, leather, stone, etc.) may vary. For wall-mounted products, the Customer must verify the suitability of the wall and fittings.
Navigation filters are support tools and do not take precedence over information shown on product pages.
Manufacturers may make minor technical/dimensional changes, and industry tolerances (including a few centimetres for upholstered items) are considered within the norm.
10. RIGHT OF WITHDRAWAL
The consumer Customer has the right to withdraw within 14 days of delivery, without penalty and without stating a reason, subject to legal exceptions.
The right of withdrawal is excluded, among other cases provided by law, for:
- goods made to measure or clearly personalised (Art. 59 Legislative Decree 21/2014; Dir. 2011/83/EU);
- non-prefabricated goods produced based on the individual consumer's choice;
- sealed goods that are not suitable for return for hygiene reasons once opened after delivery (e.g. mattresses, pillows, bed linen).
Given the made-to-order/personalised nature of most of the catalogue, the right of withdrawal does not apply to the majority of products. For specific information, contact Customer Service before purchase and in any case before production begins.
10.1 Return Procedure
To request a return, send an email to info@restylit.com stating the order number and reason. Restylit will normally respond within 24 business hours.
The Customer must return the goods within 14 days of exercising the right of withdrawal, at their own expense, in original packaging with pallet. The Customer is liable for any reduction in value due to unnecessary handling.
If a partial return causes a promotion to lapse (e.g. free shipping), the original shipping costs may be deducted from the refund, according to the rate applied to the order.
The refund will be issued within 14 days of the exercise of the right of withdrawal, subject to return of the goods within the stated timeframe.
11. POST-DELIVERY ASSISTANCE, DAMAGE AND REPLACEMENTS
The procedures described above do not limit statutory warranty rights, but are necessary for the correct management of transport damage or anomalies.
Replacement of parts or products will generally follow timeframes equivalent to production times, as these are often made-to-order items. The process is initiated upon receipt of photographic documentation within the stated timeframes.
If return of the item is required, the Customer must repackage it correctly in the original packaging. In the absence of a return request, disposal is the Customer's responsibility.
12. LEGAL WARRANTY
For consumers: statutory warranty of conformity of 24 months pursuant to the Consumer Code. For purchases with VAT number/companies: 12-month warranty, unless otherwise agreed.
For "Outlet" products from photo shoots/trade fairs/showrooms, the warranty may be 12 months for non-aesthetic conformity defects, as "used goods", in accordance with the law.
The warranty does not cover damage from improper use, incorrect assembly, impacts, cuts during package opening, or non-compliant maintenance.
13. PERSONAL DATA PROCESSING
Personal data is processed in accordance with the privacy policy available on the Site. Data Controller: Restylit S.r.l., Via dei Palustei 16, Meano di Trento (TN). Data is used to process orders and requests and may be shared with third parties only where required by law or strictly necessary for contract execution (e.g. couriers).
14. COOKIES
The Site uses technical cookies and analytics tools within the limits permitted by applicable regulations. The full policy is set out in the cookie notice on the Site.
DESIGN CONDITIONS – INTELLECTUAL PROPERTY, PUBLICATION, VALIDITY AND TIMEFRAMES
15. Intellectual Property of Design Materials
All materials created by Restylit S.r.l. in the context of consultancy and design services (3D renderings, images, graphic outputs, floor plans, layouts, moodboards, diagrams, technical drawings, presentations, and all design content) remain the exclusive intellectual property of Restylit S.r.l. and are protected by copyright law.
No transfer of economic exploitation rights is envisaged, unless agreed in writing. The Customer is granted a personal, non-exclusive, non-transferable licence of use, limited to the purposes of the purchased service. Reproduction, distribution, transfer to third parties, or commercial use without written authorisation is prohibited.
16. Authorisation for Publication (Promotional Use)
The Customer expressly and irrevocably authorises Restylit to publish and use design materials for promotional purposes on the website, social media, portfolio, newsletter, and campaigns, guaranteeing the non-identifiability of the Customer and the property (no exteriors, addresses, names, or personal data). The Customer waives any financial claims for such use.
17. Package Validity
Consultancy and design packages must be used within 6 (six) months of the purchase date. After this period, the package automatically expires with no right to a refund, extension, or recovery, unless a written extension is granted at Restylit's sole discretion.
18. Production Timeframes
The indicative timeframes for design and Blast services are 4–5 weeks, and run exclusively from the date of complete receipt of all required materials (final floor plans, measurements, photos, brief, preferences, required technical documentation).
Timeframes are estimates and may vary depending on complexity, revisions, and the timeliness of the Customer's communications.
19. Material Submission and Right to Postpone
The Customer undertakes to send the required documentation at least 15 working days before the agreed appointment date.
In the event of delay or incomplete submission, Restylit has the right to postpone the start, calls, appointments, and deliveries without this constituting a breach and without the Customer being entitled to refunds, penalties, or compensation.
